The GDPR (General Data Protection Regulation) is the European regulation regarding data protection and, among various implications, requires specific measures in website design.
It is the most significant measure of the last 20 years and has had major impacts on any organization targeting European Union citizens.
The regulation came into force on May 24, 2016, but its implementation began on May 25, 2018. Nearly 2 years after privacy compliance became mandatory, while browsing the websites of new clients as well as institutional bodies, we notice that there is still a lot of confusion and uncertainty about the practices to follow; for this reason, we decided to write this article and share useful material to clarify what to do to make your website compliant.
The objective of the GDPR
The purpose of the GDPR is to give every individual control over how their data is used, protecting the “fundamental rights and freedoms of natural persons.” In this view, strict methods are established for data processing, documentation, and storage.
Every organization, as the data controller, must record and monitor processing activities, including user consents. This includes both personal data processed internally and that processed by third parties, the so-called “data processors.” In the case of websites, data processors can be various entities, including Software-as-a-Service providers and embedded third-party services that track and profile visitors. If personal data is sent to organizations or jurisdictions that do not fall within the scope of the GDPR, or that are not considered “adequate” by the GDPR itself, the user must be specifically informed about this and the associated risks.
